This page (together with any other documents expressly referred to herein constitute the legal terms and conditions (“Terms”) on which we sell any of the goods or produce (“Products”) offered on this website, [website] (“our site”, “Website”) to you and accordingly governs the legal relationship between us (each a “Party” and together the “Parties”).
These Terms (including any updates thereto) apply to any contract between Eat Amore and you, as a customer for the sale of Products, (“Contract”) and outline your consumer rights and liabilities in law. These Terms are available in English only. We advise that you read these Terms fully and carefully, making sure that you understand them before securing any Product orders with Eat Amore via our site. If you do not agree to these Terms, please do not order from Eat Amore. We advise that you print or save these Terms for your record and/or reference.
We reserve the right to update these Terms from time to time. If you do not wish to accept the Terms as updated, you should not continue with your purchase from our site. If you do continue with any purchase, this indicates your agreement to the updated Terms and you shall be bound by the new Terms.
Registration and Use
To order from Eat Amore, you are required to register with us and create an account. You agree to provide us the required details necessary to complete your order which may include (but not limited to): your email, your billing and delivery address(es) as well as your card payment details. If these details change you must inform us promptly by contacting us via email to email@example.com.
By registering and creating an account with us (in accordance with the directions on our site), we shall only take payment on checkout of the purchase and your account will not be a credit based account. The following requirements must be met in order to create an account with Eat Amore:
- you must be over the age of eighteen;
- the details provided by you on registration should be accurate and complete. If these details change at any time you must inform us promptly by either updating your details when logged in to your account or by contacting us using our Contact Form found on our Website, link here.
When you register to use the Website you will be asked to create a password. You must ensure that this password is kept confidential as you will be solely responsible for all activities and/or orders that occur or are submitted whilst your account is logged in. If you suspect that the confidentiality of your password has been compromised, we advise that you change it immediately and/or notify Eat Amore promptly. We reserve the right to suspend your account or request that you change your password if we suspect any suspicious activity or misuse of the Website.
You are responsible for ensuring that the credit or debit details you provide are valid and accurate and contain either the Mastercard, Visa or American Express symbol.
We reserve the right to suspend deliveries to you and/or terminate any agreement with you under these Terms if we have concerns over the validity or legality of your card details. You agree to promptly and fully compensate Eat Amore for any and all reasonable costs or expenses (including legal) that we may incur as a result of obtaining payments due from you which have not been paid in accordance with these Terms.
Product images are for illustrative purposes only and therefore may vary slightly, although we have made every effort to display the products accurately.
To the exclusion of our wholesale customers, you warrant that you shall not re-sell any of the Products purchased from Eat Amore.
By selecting 'Add to basket' on an item, the relevant Product is added to your Shopping Basket facility. You are given the opportunity to review and amend the contents of the Shopping Basket, including removing items added to the Shopping Basket and amending quantities for each item before submitting your final order. After you have clicked 'Proceed to Checkout' but before you have paid for your purchase, the Website still allows you to review all the Products that you have selected and make further amend to your Shopping Basket. Your order is accepted only once you have completed payment and we then display a confirmation message.
Your payment of an order amounts to a contract offer to buy the Products from us and cannot be withdrawn or cancelled save for the Terms outlined herein.
We have no liability for the unavailability of Products (including market conditions that may affect such). If we are unable to deliver a Product, we may offer a reasonable substitute which you have the option to reject. You will not be charged for any Product that is unavailable or a substitute that you chose to reject.
All Products offered by us are subject to seasonal changes in supply levels and supply prices and some of our Products are priced by weight, being hand prepared only once we have accepted your order (for example, some Products are hand-cut). We endeavour to provide the Product as close to the ordered weight as possible however some Products are hand prepared, and therefore the weight you receive may vary from the weight displayed on the Website at the time of the completion of your purchase. Similarly, Eat Amore may receive like Products having weight variations from third party suppliers as they may be prepared by hand or priced by weight. In this instance we will display an average weight on the Product description and therefore you may receive a Product of varying weight from that displayed on the Website at the time of the completion of your purchase. If the weight of the delivered Product is significantly lower than the displayed weight we may refund you the value of the price difference between the paid for weight and the actual weight. If the weight of the Product delivered to you exceeds the displayed weight, we will not charge you more for the additional weight.
All prices for Products are inclusive of any applicable VAT at the applicable current rate chargeable in the UK. For our wholesale customers, prices are displayed net of VAT on the collection pages and inclusive of VAT on the product pages.
The prices of our Products do not include delivery fees. Delivery fees will be generated automatically in the Shopping Basket page in consideration of the value of your Products and the delivery service selected by you.
Delivery and Inspection
We will deliver your order (subject to availability and market conditions) save for where we receive confirmation from you that you wish to cancel your entire order and we are able to meet the requirements of that cancellation. You remain responsible for ensuring that any such cancellation is not only transmitted by you, but received by us. We reserve the right to deliver and charge in full for any order where we cannot meet the cancellation request. Any payments you have made for orders which have been properly cancelled will be re-credited to you as per the below terms. Despite the foregoing, if you are a consumer, then you may also cancel the order where it has not been dispatched in accordance with the below terms insofar as the order is for non-perishable Products.
Eat Amore reserves the right to charge a delivery fee for orders. This fee can vary depending on the value of the Shopping Basket, delivery location or delivery service. We will always inform you what delivery fee applies to the current items in your Shopping Basket on the Shopping Basket page and on an order confirmation.
You are responsible for making suitable arrangements to receive your delivery and giving us appropriate instructions. In the event that you give us instructions to leave your delivery in a safe place, we cannot accept any liability for the order once it has been delivered to the safe place. Accordingly, we exclude all liability for theft or damage of any Products once the delivery has been made pursuant to your instruction. You remain responsible for ensuring that any changes to your delivery instruction is not only transmitted by you, but received by us. Whilst we endeavour to keep your delivery time and day, we reserve the right to change it and will notify you if we do so. If we are unable to deliver to you or the delivery is late for reasons beyond our control (including but not limited to adverse weather conditions, strike actions, vehicle breakdown or supplier failure, we cannot accept liability for any loss, inconvenience or otherwise that this may cause you or a third party. We also reserve the right to refuse to accept orders from any customer.
We reserve the right not to deliver to all locations. If you proceed to purchase an order using a postcode to which we do not deliver to, we will cancel your order and inform you of the cancellation. You will not be charged for your order or for any delivery fees.
We will refund you for incorrect Products (Products that you have not ordered and substitutes for those Products which you have not accepted) or Products which we have not delivered in accordance with these Terms. Otherwise our liability in respect of incorrect delivery is limited to the price of the incorrect Products or the Products not so delivered subject as provided below.
You must inspect the Products at delivery and notify us promptly of any defects by emailing us via the email address provided above or contacting us through the Contact Form. We will refund you for defective Products. Otherwise our liability is limited as provided below (Warranties and Liabilities).
If nobody is home when your order is delivered by one of our courier services, multiple free of charge delivery attempts may be made by the courier. You will receive a notification that the parcel has been handed over to our courier along with an expected delivery date and time. You will be able to track, rearrange and provide additional instructions directly with our courier. If your order includes chilled products, it is your responsibility to be at the designated delivery address on the date and time of delivery. Eat Amore will not be responsible for the condition of chilled products due to unsuccessful deliveries because you are not at the designated delivery address on the day of delivery.
Although Eat Amore aims to offer you the best service possible, we make no promise that our Website services will meet your requirements and we cannot guarantee that the service will be fault free. If a fault occurs in the service, please report it to us via email to address referenced above or via our Contact Form, the link to which is provided above and we will correct the fault as soon as we reasonably can.
Your access to the Website may be occasionally restricted to allow for repairs, maintenance or improvements. In the event that our Website is unavailable, the order and cancellation provisions as outlined in these Terms applies. Please notify Eat Amore of any changes to your order via email (address as referenced above) as soon as possible.
Cancellation and Refunds
At the reasonable discretion of Eat Amore, we may suspend or cancel any accepted order or your registration immediately, including if we suspect any suspicious activity or you breach any of your obligations under these Terms. You may cancel your account with us at any time by informing us in writing and we will delete your account, however in this instance you may continue to use Eat Amore's services. The suspension or cancellation of your account shall not affect any rights and/or liabilities accrued at the date of suspension or cancellation. You will remain bound by any orders submitted by you before we received notice of your cancellation.
In the case of non-perishable Products only, our customers who are consumers (being those customers ordering the Products outside of the course of their business or trade) have the right to cancel the order and contract for those Products at any time until the expiry of the 14th day after delivery of the Products by notifying us by email via the email address provided above or contacting us through the Contact Form. For the avoidance of doubt, Saturdays, Sundays and public holidays are included in this period.
If you decide to cancel your order for any reason and have notified us as per the above, pursuant to Regulation 35(5) of Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (SI 2013/3134), you will be responsible for returning the Products at your expense to the following address (specified in accordance with Regulation 35(3) of Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (SI 2013/3134), within 14 days from the date of delivery of the Products:

On receipt of the returned Products we will refund, within 14 days a full refund of the Product purchase price and our standard delivery cost per your order subject to Regulation 34(1) of Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (SI 2013/3134).
In the case of perishable Products, you do not have the right to cancel the order or contract as per the Terms above. However, much like in the instance of non-perishable goods, you have additional rights as set out in the below clause (Warranties and Liabilities).
If you notify Eat Amore before the Product has been dispatched, then we will endeavour to credit your account with the full refund debited on purchase within 14 days of you notifying Eat Amore.
Warranties and Liabilities
Whilst Eat Amore tries to ensure that material included on the Website or in any other catalogue or materials is correct, we cannot accept responsibility if, despite our endeavours, this is not the case. Without prejudice to your statutory rights, Eat Amore may correct any inaccuracies and/or errors and we will not be responsible for any such inaccuracies and/or errors or for the results obtained from the use of such information including any technical problems you may experience with the Website.
We warrant that the products will be of satisfactory quality and, therefore, if the Products which you purchase from Eat Amore are defective in any way, you should notify us promptly in accordance with the above clause (Delivery and Inspection). We will examine the Products and, if the Products are faulty or defective we will refund the price of the faulty or defective Products. The warranty provided in this clause does not extend to any faults or defects which have been caused by your misuse, neglect or similar of the Products, including by any accidents caused while the Products are in your possession.
We shall not be liable for any delay or failure in the performance of our obligations due to events beyond our reasonable control including but not limited to fire, flood, adverse weather, equipment or supplier failure, road traffic problems, terrorism or war, acts of God, strikes, labour disputes, riots, civil unrest, accident, disruption to energy supplies.
We will not be liable to you by way of representation (unless fraudulent), common law duty or under any express or implied term of the contract for (i) any losses which are not foreseeable by you or Eat Amore in the supply and purchase of the Products, any related services or their use by you; (ii) any losses which are not caused by any breach by us; or (iii) any business or trade losses (including, without limitation, loss of profits, loss of reputation, loss of goodwill and loss of business).
Subject to the below, our entire liability under these Terms will not exceed the purchase price of the Products in question.
Nothing in these Terms excludes our liability to you for death or personal injury resulting from our negligence (including that of our employees, agents or subcontractors).
Eat Amore may offer you discount codes, as part of a promotion, in lieu of a monetary refund for certain Products, as a response to a customer complaint, or for any other reason at our discretion. In this instance, the following shall apply:
- Discount codes are not cheque guarantees, credit or charge cards and they cannot be redeemed or exchanged for cash.
- The discount codes cannot be redeemed via telephone or mail-order.
- You redeem the value of your Eat Amore discount pursuant to the instructions given at the time the discount is in promotion. This may be by entering a unique voucher code on the checkout page which would then be automatically applied to your final purchase price.
- Discount codes cannot be used to pay for any applicable delivery fees unless the discount specifically covers delivery fees. If the discount code does not cover delivery fees you will have to pay separately for any applicable delivery fees.
- Discount codes cannot be applied in conjunction with any other promotions or in respect of wholesale Products.
- Discount codes can only be used once up to a maximum of the full value of the discount code and therefore if the full value of the discount code is not used as part of a single purchase, the remaining value is forfeited by you.
- Only one discount code can be used for any single purchase.
- Discount codes may be subject to an expiry date and automatically expire at the end of that period.
- All refunds of goods or services purchased with discount codes will be made in accordance with Eat Amore's refund policy and this does not affect your statutory rights.
The allergen info and guideline on our website is made in accordance to the information received by the producers. but, not being us the manufacturers, we then pass any the responsibility to the producers themselves, not being Eat Amore the manufacturer of any of the goods offers on this website.
You may not assign, sub-license or otherwise transfer any of your rights under these Terms.
The provisions of the Contracts (Rights of Third Parties) Act 1999 are expressly excluded in these Terms so far as permitted by law to the extent that no third party may claim any rights under that contractual relationship (but this shall not affect any right or remedy of a third party which exists or is available apart from that Act).
If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.
If you are a consumer (an individual acting outside of the course of your business or trade), there are certain terms implied into your contract with us, which we cannot exclude, or limit (for example, under the Sale of Goods Act 1979 we have to supply goods to you which are fit for their purpose). It is important for you to know that nothing in these terms affects your statutory rights. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales and any dispute or claim arising out of or in connection with these Terms or the contractual relationship created pursuant to the same will be governed by English law. You agree to the exclusive jurisdiction of the courts of England and Wales.
